General terms of business

1. Scope of application
The following general terms of business apply exclusively to business relations between Bogar AG and its customers. Any customer terms which depart from these will not be recognised by Bogar AG except where Bogar AG has agreed their validity in writing.

2. Conclusion and termination of contracts
The customer may cancel the contract within two weeks in writing (including email) or by returning the goods. There is no right to cancel a contract if the seal on the packaging of the goods has been broken. None of Bogar AG’s products may be sold to minors.

3. Deliveries and despatch costs
Your order will normally be posted 1 - 2 working days after receipt of your purchase order. The flat-rate cost per consignment is € 9 for Germany and € 14 for other EU countries.

4. Delivery
Unless otherwise agreed, the consignment will be despatched from our warehouse and delivered to the customer’s invoicing address.

5. Terms of payment, default
The purchase price on the invoice enclosed with the goods is to be paid by the customer within 30 days. If the customer fails to pay on the due date, Bogar AG will be entitled to charge penalty interest at 5% p.a. above the base rate published by the Swiss Central Bank. Where Bogar AG is proved to have suffered a loss greater than this amount, Bogar AG will be entitled to claim for such a loss. For deliveries outside Switzerland, all additional costs incurred (e.g. import tax, customs charges, etc.) are charged directly by the postal delivery service.

6. Ownership of goods
The goods delivered remain the property of Bogar AG until payment is made in full.

8. Applicable law
All obligations resulting from this contractual relationship are subject to Swiss law. Zurich is the sole place of jurisdiction for all legal disputes arising from this contractual relationship and concerning its creation and effectiveness.
